1. Introduction.
Welcome to the Cannabis Art Gallery “Terms and Conditions”.
The Cannabis Art Gallery website (cannabis-artgallery.com), products, materials and any other related information are designed, administered, owned and operated by corporation Mary and Jane, a Dutch incorporated sole ownership, with registered office in Amsterdam, the Netherlands.

(Hereinafter referred to as “the Cannabis Art Gallery”,”CAG”,“we”, “us”, “our(s)”)
The Cannabis Art Gallery (hereafter referred to as CAG) is specialized in creating art with the main focus on displaying the cannabis plant in society. CAG develops unique art that is both physical and digital. CAG products can be resold through multiple third party channels. The first release of an art piece, will mostly but not limited to, be launched on the website of CAG, reselling is supported through third parties that are not owned or connected with CAG. CAG provides multiple payment options and uses multiple third party payment providers. Each art piece that is released by CAG is linked to a Non-fungible token, serial code and invoice. CAG makes it possible to subscribe for notifications, fill in contact forms and create a personal account. CAG offers multiple services for buyers, holders and sellers. The Cannabis Art Gallery has set up a system to protect the art piece authenticity and value as much as possible.
In order to operate according to the regulations, expectations and the CAG procedures, CAG detailed described the terms and conditions. If something is not clear or if you have any questions, feel free to contact CAG by sending an email to info@cannabis-artgallery.com.
2. Acceptance of Terms
As buyer, holder and/or seller of Cannabis Art Gallery product(s), by accessing the Cannabis Art Gallery website, by using Cannabis Art Gallery services, by filling in contact forms and by buying any Cannabis Art Gallery products you agree to comply with and be bound by the following Cannabis Art Gallery system, expectations, regulations, terms and conditions following below. Including, but not limited to, the Cannabis Art Gallery Privacy Policy.
When registering for an account, filling in any contact form, using any of the CAG services, buy, hold and/or sell any CAG product(s), you will be asked to agree to be bound by these terms of use.
If you do not agree to these expectations, regulations, terms and conditions, you must not use the Cannabis Art Gallery website, services, contact forms and/or buy, hold and sell any products from the Cannabis Art Gallery. If you continue using the website, any CAG service and/or product(s) constitutes, you accept these expectations, regulations, terms and conditions, including any updates or modifications made from time to time.
If you are using the website on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these expectations, regulations, terms and conditions.
3. Changes to Terms
We reserve the right to update, modify, or replace these expectations, regulations, terms and conditions at any time without prior notice. CAG reserves the right to inform you when needed. Any changes will be effective immediately upon posting on the website. Your continued use of the website after any changes constitutes your acceptance of the revised expectations, regulations, terms and conditions. We encourage you to review these expectations, regulations, terms and conditions periodically to stay informed about any updates.
4. User Responsibilities
Any activity that can have a negative impact on the Cannabis Art Gallery, CAG employees and CAG customers is prohibited and can have legal consequences. This includes but is not limited to: hacking, spamming, trolling, and/or disturbing.
As a user of the Cannabis Art Gallery website account, services, and/or products, you are legally required to always provide self-determined accurate information.
All information and data on the website, self-determined information, and any other intellectual property rights is owned by the Cannabis Art Gallery. This can not be used by anyone without permission from the Cannabis Art Gallery.
As buyer, holder and/or seller of Cannabis Art Gallery products and/or user of Cannabis Art Gallery services, you are required to follow the terms and conditions together with the regulations and expectations of the Cannabis Art Gallery system.
The Cannabis Art Gallery is not responsible and/or legally bound for any self-determined information. CAG can use the self-determined information any time, for any purpose, without prior notice. CAG is not responsible and/or legally bound for any negative image and/or impact on any individual and/or organization.
5. Account Registration
The Cannabis Art Gallery makes it possible to create an account on the website. Having a personal account gives you the possibility to interact with the CAG.
By creating an account, you automatically agree to join the CAG community. Users in the community will receive the option to interact, collect and store data. CAG uses the community group to improve experiences, create value, and recognize valuable collectors.
With your consent, to receive marketing communications and promotional materials related to our products and services. You have the right to opt-out of these communications at any time by unsubscribing from the mailing list. You have always the option to delete your personal account at any time. See our Privacy Policy for detailed information. For any questions or issues regarding your personal information, you can always immediately email us. Info@cannabis-artgallery.com. We will contact you as soon as possible to support you with any question(s).
When creating a personal account, you agree to:

Provide and keep accurate and complete information about yourself;

Maintain the confidentiality of your profile and your login credentials, if applicable;

Once you have asked us to create your personal account, via the website or any other means, including our customer service, your personal information will be linked to this personal account.
The information in your personal account is crucial to provide you with a personalized and tailored experience, and in some cases is necessary in order to access some specific services or to purchase from our website, and thus it needs to be kept up to date for the best experience. You agree to accept responsibility for all activities that occur under your personal account, whether you have authorized those activities. If we have reasonable grounds to suspect that the information you provide impersonates another person, CAG reserves the right to suspend or terminate your personal account. CAG reserves the right to delete any account, without any reasoning, or prior notice.

6. Intellectual Property
The website, marketing and social media content, including but not limited to; text, images, logo and data is owned by the Cannabis Art Gallery. Any reproduction, distribution and/or modifications are prohibited without permission from the Cannabis Art Gallery.
All copyrights are reserved by the Cannabis Art Gallery.
7. User-Generated Content
Any self-determined information and data need to be according to our policies and guidelines.
This includes the following:

Any content that is shared on the CAG website needs to be honest and accurate information.

Any content that is offensive, illegal, harmful and/or political is prohibited. Including any content that can have a negative impact on the CAG, CAG employees or CAG customers.

Content submitted by any individual needs to provide a positive impact and/or need to be beneficial to the community.

All self-determined submitted content can be used by the CAG without any permission, notice or consequences.
CAG will always do its best to maintain a positive and friendly community. And will take action if it is not the case.
The Cannabis Art Gallery is not responsible and/or legally bound by any self-determined content and/or consequences.
8. Privacy Policy
Cannabis Art Gallery (non)automatically receives, collects and stores data from website visitors. Detailed information about the data the CAG collects, and your rights as a website visitor, can be found in our Privacy Policy.
9. Payments
Each Cannabis Art Gallery’s art piece of one identical collection will be sold for the same selected price. When a collection gets released, interested collectors can register for the art piece(s) in order to potentially buy them. Due to high demand and CAG operational policy in equality, potential buyers have to register for the art piece they would like to buy. A potential buyer will be selected from the application list of the art piece in question. After the potential buyer is selected, the following terms and conditions apply:

The potential buyer has twenty-four-hours, after being selected, to transfer the value of the art piece in the currency of choice, mutually accepted by the CAG. If the currency transfer is not completed within the twenty-four-hour deadline, a new potential buyer will be selected from the application list and approached for interest.

Depending on the currency of choice, the CAG will contact the selected buyer and send a payment instruction to transfer the currency, secured and correctly within the deadline. CAG uses third party payment providers to transfer currencies. CAG is not responsible and/or legally bound by any activity of the third parties.

After CAG receives the payment, CAG will contact the new owner of the art piece in order to send the art piece invoice and additional information.
The owner has then the option to receive the art piece together with the non-fungible token (hereafter referred to as NFT) or to receive only one of the two. For more information regarding CAG (storage) services and shipment, see chapter 10 ”CAG system”, chapter 10.4 “CAG storage” and chapter 20 “Shipments”.

After transferring currency to CAG, for the art piece where you applied for, you agree to comply with, and be bound by, the regulations and responsibilities of the CAG system. See chapter 10 for the “CAG system” including expectations, regulations and responsibilities.
CAG offers multiple payment options, including fiat and digital currencies. CAG payments will be supported by third party payment providers. By buying CAG products and by using CAG services, you agree to comply with and be bound by the payment provider's and CAG terms and conditions regarding payment responsibilities.
The Cannabis Art Gallery is not responsible and/or legally bound for the following, includes but not limited to, any payment failures, errors, lost transactions, missed deadlines and/or any third party payment provider.
10. CAG system.
Detailed regulations, expectations, terms and conditions, for CAG art buyers, holders,
(re)sellers, and mediators.
10.1 Collection launch - registration.
Cannabis Art Gallery launches non-sequential, a series of six art pieces that form together one collection. Due to the high demand, and CAG procedure policy for equality, potential buyers have the ability to register for the art piece, they are able, and would like to buy. Potential buyers have the possibility to register for multiple art pieces. The registration for an art piece is open for a limited time. After the deadline, it is not possible anymore to register as a potential buyer for an art piece of that collection. By registering for potentially buying an art piece, you automatically agree with CAG privacy policy, CAG system, terms and conditions.
CAG is not responsible for any deviation from the registration process, any errors, problems and/or failed applications. CAG is also not legally bound by deviations of the registration process mentioned here above. CAG reserves all rights in adjusting and deviating from the registration process without any notice.
10.2 Selection procedure.
CAG saves and collects the data that is submitted in the register form of the art piece. (See privacy policy) After the registering deadline, CAG selects someone from the list of potential buyers. The selected potential buyer gets contacted by the CAG. After being selected, the buyer has twenty-four-hours to transfer the art piece value in the preferred currency. If the selected potential buyer can not meet the expectations, a new potential buyer will be selected and contacted, without exceptions and any (prior) notice.
CAG is not responsible for any deviation from the selection process, any errors, problems and/or failed selections. CAG is also not legally bound by deviations of the selection process mentioned here above. CAG reserves all rights in adjusting and deviating from the selection process without any (prior) notice.
10.3 Potential buyer payment responsibility and expectations.
As a selected buyer for the CAG art piece, you have twenty-four-hours to transfer the value of the art piece in the currency of choice, mutually accepted by CAG. It is the buyer’s responsibility to transfer the currency within the time of the deadline. If the buyer did not transfer the currency within the deadline to CAG, a new potential buyer will be selected and contacted without exceptions and any notice.
CAG is not responsible for any deviation from the payment process, any errors, problems and/or failed payments. CAG is also not legally bound by deviations of the payment process mentioned here above. CAG reserves all rights in adjusting and deviating from the payment process without any (prior) notice. CAG is not responsible and/or legally bound for any third party payment providers. Including but not limited to; currency transfers, payment request, payment options, currency options, internal and external deviations, errors, problems and/or any other related unexpected situation(s).
10.4 Art piece storage regulations and expectations.
Cannabis Art Gallery advice to store your art piece and NFT safe and secured. CAG advises storing the physical art piece in a dark, low humidity environment. CAG is not responsible or legally bound to any theft, loss or damages. CAG is not able to re-print, restore and/or re-issue any art piece and/or NFT. The art piece value without NFT or physical art piece is not protected by the CAG. CAG does not support trading CAG art and/or products that are invalid, incomplete, damaged and/or stolen. It is the art piece owner’s responsibility to keep the physical art piece complete, undamaged and together with its NFT. CAG is not responsible and/or legally bound for any storage deviation. This includes, but is not limited to, any loss, theft, storage problems, damages, invalid art piece(s) and/or products. This applies for both CAG internal and external storage service options and for the CAG art piece/product owner without the usage of CAG storage services.
10.5 Owner’s regulations, responsibilities and expectations.
Cannabis Art Gallery expects that the owner of an CAG art piece(s)/product(s) takes full responsibility in preserving the art piece(s)/product(s) authenticity, quality and value. CAG expects that the owner of a CAG art piece(s)/product(s) follows and respects the CAG system, services, privacy policy, terms and conditions. CAG expects that the owner follows the regulations regarding buying, holding and selling CAG art piece(s)/product(s). It is the owner’s responsibility to inform CAG if the art piece(s)/product(s) gets resold. It is the owner’s responsibility to send an art piece to CAG for maintenance and repairs, when needed. It is the owner’s responsibility to keep the art piece together with the NFT. CAG is not responsible and/or legally bound, that includes, but is not limited to, any misunderstanding of the owner, any deviation of the owner’s responsibilities and expectations, Owner’s loses and any other related causes.
Any deviation from the owner’s responsibilities can conclude in CAG not supporting the art piece. For more information, see chapter 10.9 “Not supported by CAG”.
10.6 Art maintenance and repairs.
CAG advises the owner of a physical art piece to protect the art piece at all costs. CAG advises to store/display the art piece in a dark and low humidity environment. Any maintenance and/or repairs on the physical art piece is forbidden. Any maintenance and repairs needed can only be executed by the CAG or CAG selected third parties. Any repairs or maintenance completed on any CAG art piece and/or product, without the CAG consent, is not supported by the CAG. The value and/or authenticity is then no longer protected by the CAG. CAG is not responsible and/or legally bound for any art piece and/or product that is no longer supported by the CAG.

10.7 Trading art regulations, responsibilities and expectations.
Trading in CAG art piece(s) and/or products(s) is only supported by the CAG under strict regulations, expectations and responsibilities. CAG follows strict procedures in order to protect each individual art piece's authenticity, quality and value. In order to trade CAG art piece(s) and/or product(s) the owner need to follow the following regulations, responsibilities and expectations;
Before selling any art piece(s) and/or product(s), the owner is required to inform CAG about the transfer. CAG will ask the following;

If the art piece(s) or NFT(s) are stored at one of CAG storage options.

What you want to transfer to the new owner (Art piece, NFT or both).
-
If you want to store the art piece(s) or NFT(s) by CAG, to support the efficiency of the transfer.

If you want to use the CAG anonymous service for reselling your art piece(s) and/or product(s).

If you need any other support or service(s) from the CAG to simplify and support the trading transfer.
The new owner then has the following responsibilities;

Request a new proof of ownership certificate.

Request the art piece or NFT (Only when needed).
-
Double check the authenticity with CAG.

Checking for damages, if applicable, request repairment appointment by CAG. info@cannabis-artgallery.com
The Cannabis Art Gallery is not responsible and/or legally bound for any deviation, expectation and/or disappointment. It is the owners responsibility to follow the CAG system and regulations to maintain the art piece(s) quality, value and authenticity.
10.8 CAG services.
CAG offers different services in order to improve, simplify and/or support collecting and trading in CAG art piece(s) and/or product(s). Most of the CAG services are offered for free to use. The free services are limited to the demand. CAG reserves the right to increase the pricing of CAG offered services. CAG most likely, but is not legally bound to, informing CAG service users for any possible service change(s) and cost increase(s). CAG is not responsible and/or legally bound for any changes regarding the service procedures and pricing.
10.9 Not supported by CAG.
CAG supports an art piece(s) and/or product(s) authenticity and value only if it is according to the CAG criteria. In order to support the authenticity and value of an art piece, CAG follows a protection procedure. If an art piece and/or product does not comply anymore to the criteria from the procedure, CAG no longer supports the art piece. This means that the art piece authenticity, value, and quality is no longer to the CAG standards.
If an art piece is no longer supported by the CAG, it can no longer use any services from the CAG. This ban is immediately effective after the official diagnosis.
Protection procedure criteria includes, but is not limited to, Theft, unauthorized repair(s) and/or maintenance, replica’s, unauthorized reselling, Art piece without NFT, NFT without art piece, incomplete documentation.
CAG is not responsible and/or legally bound by any cause associated with an unsupported art piece. CAG reserves the right to decline to support any art piece authenticity, quality and value grounded on any reason without any further explanation and notification.
10.1.1 CAG disclaimer.
Cannabis Art Gallery reserves the right to change, deviate, and/or re-arrange any procedure. This includes, but is not limit to;
Registration procedure, Selection procedure, Selling procedure, Payment procedure, Storage procedure, Owners regulations, Art maintenance, Trading regulations, Production procedure, Data usage procedure, Marketing procedure, Reselling procedure, CAG services, or any other procedure executed by CAG. CAG is not responsible and/or legally bound for informing any changes to any individual and/or organization. CAG encourages any individual to read and understand the “Terms and Conditions” any time before using any product and/or services from the CAG.

CAG is not responsible and/or legally bound by any change, deviating and/or re-arranging any procedures or services.

CAG is not responsible and/or legally bound by not complying to the customer's expectation, CAG procedure, or promises.

CAG is not responsible and/or legally bound by anything that is created or produced by the CAG. Including, but not limited to, digital and physical material and data.

CAG is not responsible and/or legally bound for any harm and/or damages to any property, material(s) or equipment(s) that is used for creating any art and/or products.

CAG is not responsible and/or legally bound for image damage to any individual and/or organization that is displayed in any created art piece and/or products.

CAG is not responsible and/or legally bound including, but not limited to; any political, cultural and/or social measures. CAG is displaying a cannabis plant in the form of art. CAG is free in cultural expression through art, according to the headquarters country (the Netherlands) laws and regulations.
11. Limitation of liability
To the fullest extent permitted by law, Cannabis Art Gallery and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from;

Your access to or use of, or inability to access or use, the website;

Any conduct or content of any third party on the website;
-
Unauthorized access, use, or alteration of your transmissions or content.
In no event shall our total liability to you for all claims arising out of or related to the website exceed the amount you paid, if any, to us for accessing or using the website.
12. Disclaimer of warranties
The website and its content are provided on an 'as is' and 'as available' basis, without any warranties of any kind, either express or implied. Cannabis Art Gallery disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the website will be error-free, secure, or uninterrupted, or that any defects will be corrected. Your use of the website is at your sole risk.
The Cannabis Art Gallery is not responsible and/or legally bound by any warranty expectation and/or deviation, website failure, and/or any other digital error.
13. Termination
We reserve the right to terminate or suspend your access to the website, without prior notice or liability, for any reason, including but not limited to your breach of these terms and conditions. Upon termination, your right to use the website will immediately cease. All provisions of these terms that, by their nature, should survive termination (including but not limited to ownership provisions, disclaimers, indemnification, and limitations of liability) shall remain in effect after termination.
The Cannabis Art Gallery is not responsible and/or legally bound for any termination for any reasoning.
14. Governing law
These terms and your use of the website shall be governed by and construed in accordance with the law, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these terms and conditions or the website shall be brought exclusively in court, and you consent to the jurisdiction of such courts.
15. Dispute resolution
In the event of any dispute, claim, or controversy arising out of or relating to these terms or the website, you as individual and/or organization, agree to first attempt to resolve the dispute informally. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration administered in accordance with its rules. The arbitration shall take place and the arbitrator's decision shall be final and binding. You waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration. By using the CAG website, services and/or products, you agree to first dissolve any legal case, disagreement and/or issue with CAG informally before any juristic measurements. CAG reserves the right to start any juristic measurements without any informal conversation.
16. Third-Party links
Cannabis Art Gallery uses and reveres to third party applications, businesses and websites. CAG is not responsible for any operation, action or damage from the revered third parties. Using services of the third parties revered by the Cannabis Art Gallery is your own risk and responsibility. For any issues regarding the usage of the services from the referred third parties, please feel free to contact the customer service of the third parties in question.
Cannabis Art Gallery encourages to read and understand the terms, conditions and policies of the third parties, referred by the CAG.
Cannabis Art Gallery is not responsible and/or legally bound for any third parties action, service(s), (dis)agreements, disappointment(s) and/or loss(es).
17. Indemnification
You agree to indemnify, defend, and hold harmless Cannabis Art Gallery’s, affiliates, officers, employees, agents, partners, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to;

Your use of the website;

Your violation of these terms;

Your violation of any third-party right, including but not limited to intellectual property rights;

Any content you submit or transmit through the website.
18. Severability
If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely achieves the intended purpose of the original provision.
19. Entire agreement
These terms constitute the entire agreement between you and Cannabis Art Gallery regarding your use of the website and supersede all prior or contemporaneous agreements, understandings, or representations, whether oral or written. No waiver of any provision of these terms shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision.
20. Transport and shipments
Cannabis Art Gallery use third party shipment providers in order to send art piece(s) to the owners. Each art piece that needs to be shipped will be linked to a track and trace code (if possible). This is a CAG extra service in order to secure the location of the art piece. CAG will insure the art piece value by a shipment insurance contract. CAG is not responsible for any shipment damages, losses, or any other shipment relevant disappointments. CAG is not responsible for shipment related problems. Any legal responsibility is for the owner and/or shipment provider. CAG does not support any legal disagreements of the owner or shipment provider. CAG is not responsible and/or legally bound that includes, but not limited to, shipment loses, damages, disappointments, delays and/or any other shipment related causes.
